An invention is the legal form of the manufacturer's labour. Unlike a trademark, a patent does not protect a name — it protects a technical solution, and for 20 years it prevents others from commercially exploiting the same solution.
§1 The three requirements for patent protection
Under SMK No. 6769 art. 83, the following must be satisfied simultaneously:
Novelty: The invention must not exist anywhere in the world, in any language, publication or prior use. A single earlier disclosure destroys novelty. 12-month grace period: Disclosures made by the inventor or their successor within the previous 12 months are exempt (art. 84/3); disclosures by third parties are not.
Inventive step: The invention must not be an ordinary development for a person skilled in the art; a creative leap is required.
Industrial applicability: The invention must be capable of being made or used in any branch of industry, including agriculture.

§2 Subject matter excluded from patent protection
Under SMK arts. 82/2 and 82/3:
- Discoveries, scientific theories, mathematical methods
- Aesthetic creations (copyright/design scope)
- Pure software programs (software with a specific technical effect is treated differently)
- Methods of doing business and mental activity
- Methods of treatment and diagnosis on humans/animals
- Plant and animal varieties obtained through essentially biological processes
- Inventions contrary to public order
§3 Filing process
- Prior-art search — Espacenet, Patentscope, TÜRKPATENT database (1–2 months)
- Specification drafting — full technical description + sample embodiments + claim structure (2–3 months)
- EPATS filing — filing fee paid, filing date secured
- Formal examination — any deficiencies must be addressed within 2 months
- Novelty search — TÜRKPATENT or an authorised international office report (~12 months)
- Substantive examination — assessment of novelty, inventive step, industrial applicability
- Bulletin publication — 6-month opposition window
- Grant — patent certificate issued
- Annuity fees — paid every year for the life of the patent (non-payment causes the patent to lapse)
Total duration: 2–4 years.
§4 Anonymised case
A furniture maker in an OSB developed a new cushion-filling composition. An Espacenet search turned up a similar German patent; however, our client's composition relied on a different chemical combination (inventive step preserved). The application was granted 2.5 years after filing; today the firm exports to the EU under the same composition.

§5 Patent vs Utility Model
For patents, inventive step means "not obvious to a person skilled in the art"; for utility models, "non-obviousness" is sufficient (a more flexible standard). Utility models grant 10 years' protection, patents 20 years. Methods and chemical substances are protectable only via the patent route.
