Asil Patent ve Danışmanlık — TÜRKPATENT Marka Sicili 188 · Patent Sicili 167

Power of Attorney

Wet-signed authorisation enabling Asil to act on your behalf in trademark, patent, utility model, design and geographical indication application proceedings.

What is a power of attorney?

A power of attorney (vekaletname) is the written authorisation that enables a registered trademark or patent agent to act on a client's behalf before TÜRKPATENT. It is required for Asil to file, monitor, defend and renew your applications under the Turkish Industrial Property Code (SMK 6769).

Is notarisation required?

No. Trademark and patent powers of attorney do not require notarisation in Türkiye. A wet-signed form is sufficient. This speeds up the process and eliminates any additional notary expense.

Scope of the power of attorney

A single power of attorney covers multiple trademark and patent files for the duration of representation. The scope is set out in the form. In general it covers:

  • Filing, prosecution and responding to office actions
  • Oppositions and defence proceedings
  • Renewals and assignments
  • Representation in court proceedings (within the limits permitted by law)
  • Correspondence with official authorities

Revoking the power of attorney

If you wish to end the representation, you may revoke the power of attorney by written notice to Asil. After revocation, the status of your files is shared with you, and your new agent initiates the file transfer with Asil.

Is there a fee for the power of attorney?

No. The form is free to download. There is no notary fee (the form does not require notarisation). Asil's agent service fee is quoted separately on a per-file basis.

Frequently asked questions

→ Yes. A new power of attorney is signed and submitted together with a revocation letter for the previous one.
  • Who must sign a power of attorney on behalf of a company?
→ An authorised signatory of the company (director, manager) signs and applies the company stamp. The trade registry gazette may also be requested.
