Patent Prior-Art Search and Analysis
- Duration
- Standard search 2-4 weeks · FTO report 4-8 weeks
The most critical step before a patent application: determining whether the same or a similar invention has already been patented. Inadequate prior-art research → rejected application + lost 5,000-15,000 TRY + 12-18 months.
Asil's patent prior-art services are offered at three levels:
- Free tool — 7-question decision tree at /araclar/patent-uygunluk-testi/ — determines whether your invention is a patent or utility model
- Standard search (2-4 weeks) — agent-conducted expert scanning of TÜRKPATENT EPATS + WIPO Patentscope + EPO Espacenet
- FTO report (4-8 weeks) — Freedom-to-Operate, infringement risk analysis, patent landscape for export markets
§1 Standard prior-art search (2-4 weeks)
Expert scanning by the agent team:
| Database | Scope |
|---|---|
| TÜRKPATENT EPATS | Registered + pending patents in Türkiye |
| Espacenet (EPO) | 130+ million patent documents, 100+ countries |
| WIPO Patentscope | PCT applications + national phase |
| Google Patents | Multilingual + academic article matching |
| Academic databases | Novelty check against scientific literature |
Deliverable: 8-15 page written report — similar documents found, novelty assessment, inventive step analysis, application recommendation (proceed / revise / high rejection risk).
§2 FTO (Freedom-to-Operate) report
Critical for export-oriented manufacturers — answers the question "If I sell my product in the EU, am I infringing someone else's patent?" in writing.
FTO report scope:
- Active patents in target markets (not yet expired)
- Overlap of patent claims with the product
- Infringement risk level (high / medium / low)
- Design-around recommendations
- Licensing options
Deliverable: 20-40 page detailed report + verbal briefing. Not a legal opinion but a foundation for investment decisions + export planning.
§3 Asil's tool vs consulting
The free Patent Eligibility Test — a 7-question decision tree determining whether your invention is patent, utility model or unprotectable. Gives a preliminary verdict.
This page — when you already know it's a patent, professional research before application. If the tool's output is "patent application appropriate," the next step is here.
The two levels complement each other — free tool for screening, professional research for deep verification.
§4 Cost range
| Service | Cost range (2026) |
|---|---|
| Patent Eligibility Test (tool) | Free |
| Standard prior-art search | 6,000 – 12,000 TRY |
| FTO report (Türkiye + EU) | 18,000 – 35,000 TRY |
| FTO report (Türkiye + EU + USA) | 35,000 – 60,000 TRY |

§5 When is it needed?
- Before patent application — reduces rejection
- Before investment decision — risk assessment before R&D commitment
- Company acquisition — due diligence on target's patent portfolio
- Export planning — before new market entry
- Competitor monitoring — sector trend tracking (annual periodic search)
§6 TÜBİTAK 1602 support
Beyond patent filing fees, prior-art search costs are also reimbursable under TÜBİTAK 1602 Patent Support Programme. Asil coordinates the TÜBİTAK application alongside the search process.
