Your trademark registration is valid for 10 years. If you do not renew when the term ends, your right lapses — and another party may register the same mark. This page explains the renewal window, fee structure, and the mistakes we most often see.

§1 The renewal window

Under SMK art. 23:

  • Final 6 months (standard window): the 6 months before the protection term ends
  • Additional 6 months (penalty window): the 6 months after the term ends — at the late-fee rate

If this 12-month window passes, your trademark right is terminated and removed from the register. To bring the mark back, you must file a fresh application and go through the entire process again; any earlier "priority right" is also lost.

§2 How we work at Asil

§3 Anonymised case

A Kayseri textile firm forgot to renew its 2014 trademark in 2024. An İstanbul firm filed an application on the same mark. The client was not working with us; we took over the file at the end of 2024. After a 2-year action that went up to the Court of Cassation, the prior-use right was upheld — but both cost and time were lost in the process.
