PCT International Patent Application

30-month reservation + national phase

If you have an export target, instead of obtaining patent protection in each destination country separately, the PCT route lets you reserve rights in 150+ countries for 30 months through a single international filing. During that window, you decide which countries to actually enter.

§1 How PCT works

  1. International application — filed via TÜRKPATENT or directly with WIPO. One file, one language, one fee.
  2. International Search Report (ISR) — within 16 months, the competent office (TÜRKPATENT or EPO) issues a prior-art report.
  3. International Preliminary Examination (optional) — by the end of month 28.
  4. Publication — on Patentscope at month 18.
  5. National phase entry — at month 30, you decide which countries to enter; each country's own procedure begins.

§2 PCT advantages

  • 30 months of deliberation (to see market development and financing status)
  • A single file format (no need to draft a new specification for each country)
  • An international search report — global prior-art intelligence
  • When TÜRKPATENT is the competent office, the application can be filed in Turkish
  • Cost deferral (the main expense lands at national phase entry)

§3 PCT limitations

  • The patent decision is made separately in each country; PCT does not "grant"
  • Missing the national-phase deadline at month 30 forfeits the right
  • Some jurisdictions are not PCT members (Taiwan, etc.) — a direct national filing is required

§4 TÜBİTAK 1602 support

PCT filing fees, ISR costs and national-phase fees can be reimbursed under the TÜBİTAK 1602 Patent Support Programme. University–industry collaboration files have a dedicated quota.

§5 Anonymised case

A Kayseri R&D centre filed a national patent application for a new control module on a food-processing line in 2021. The PCT route was taken in month 10; at month 30, national phases were entered in the United States, the EU, China and India. Today the grant is complete in all four jurisdictions; the firm has started international licensing discussions.
